1. Acceptance of Terms

By registering as a seller on our marketplace, you agree to be bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations.

2. Seller Eligibility

• Must be 18 years or older
• Must provide valid identification and business registration documents
• Must have a valid Kenyan bank account or approved international payment method
• Must comply with all applicable Kenyan laws and regulations
• Must maintain accurate and up-to-date business information

3. Product Listings and Sales

3.1 Prohibited Items

• Counterfeit or unauthorized goods
• Illegal substances or drugs
• Weapons, firearms, or ammunition
• Adult content or explicit material
• Stolen goods
• Hazardous materials
• Products that infringe on intellectual property rights

3.2 Product Requirements

• Accurate descriptions and images
• Clear pricing including all taxes
• Valid KEBS certification where required
• Compliance with Kenyan standards and regulations

4. Fees and Payments

4.1 Commission Structure

• Standard commission: 5% per transaction
• Payment processing fees: 2.5% for card payments
• M-Pesa transactions: 1.5% fee
• International transactions: Additional 1% currency conversion fee

4.2 Payment Schedule

• Payments processed every 14 days
• Minimum payout amount: KES 1,000
• Deductions for returns and chargebacks
• Tax compliance: All sellers responsible for their own tax obligations

5. Data Protection and Privacy

We comply with the Data Protection Act, 2019. By using our platform, you consent to:

• Collection and processing of your personal data
• Storage of your data in secure servers
• Use of your data for platform operations and improvements
• Sharing necessary information with payment processors and delivery partners

6. Intellectual Property

You retain all intellectual property rights to your products and content. However, by listing on our platform, you grant us a license to:

• Display your product images and descriptions
• Use your business name and logo for promotional purposes
• Share your products across our marketing channels

7. Seller Responsibilities

• Maintain product quality and accurate inventory
• Process orders within 48 hours
• Provide customer support for your products
• Handle returns and refunds according to platform policy
• Maintain positive customer feedback (minimum 4.0 rating)
• Update business information within 7 days of changes

8. Platform Rights

We reserve the right to:

• Suspend or terminate seller accounts for violations
• Remove listings that don't comply with our policies
• Modify fees and terms with 30 days notice
• Withhold payments for investigation of suspicious activity
• Use seller data for platform analytics and improvements

9. Liability and Disclaimers

We are not liable for:

• Product quality or seller-buyer disputes
• Shipping delays or damages
• Technical issues beyond our control
• Financial losses from platform usage
• Third-party service interruptions

10. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved through arbitration in Nairobi in accordance with the Kenyan Arbitration Act.
